Khalid Pervez, president of the Coca-Cola Workers Union in Rahimyar Khan, Punjab Province, Pakistan has returned to work following IUF pressure to implement the decision of the Punjab High Court which ruled that Coca-Cola management had unjustly dismissed the union president in October 2001.Management had dismissed the union president claiming he had forced workers to strike. After a delay of two years the labour court ruled in August 2003 to reinstate the president with back benefits. Coca-Cola Pakistan management challenged this decision in the Punjab High Court. Almost a year later, the High Court, on 15 July 2004, rejected the appeal. Management did not accept the court's decision, refused to reinstate the president and sought to appeal to the Supreme Court of Pakistan. The Supreme Court refused to hear the appeal. During this period the IUF consistently approached Coca-Cola head office in Atlanta over the baseless dismissal and local management's intransigence. The union approached the labour court regarding non-implementation of the High Court's decision by the management. On 25 September 2004 the court ordered the management to take Khalid Pervez back on duty. Finally, almost three years to the date since he was dismissed, Khalid Pervez was issued a return to work letter on 26 September 2004, yet local management did not actually allow him to enter the factory for the next three months. IUF again raised the issue with Coca-Cola head office and on 16th January 2005 Khalid Pervez was able to return to work. Subsequent to returing to work, Khalid Pervez won his final court battle with management ordered to pay Pak Rs. 210,000 (US$3,500) in back wages. The management hAVE indicated they will pay the amount.
